Company Introduction

We are Destination Nation Limited, whose registered office is 2nd Floor Gadd House Arcadia Avenue London N3 2JU United Kingdom (“us”, “we”, “our”) is the UK’s independent serviced apartment agent and we provide reservation and payment services to enable our clients (“you”) to reserve serviced apartments worldwide (“Reservations”) which are provided by our various apartment providers (our “Apartment Providers / Suppliers”).

Reservation Terms

  • You agree that your Reservation will be strictly subject to these terms and conditions (“Terms”) and that in relation to your Reservation and use of the apartment you agree to be strictly bound by these Terms and by any general policies, rules, terms or conditions of the Apartment Provider (the “Apartment Provider’s General Policies”). If you’re making the Reservation on somebody else’s behalf and/or any other third party will be making use of the serviced apartments you, in addition, will procure their compliance at all times with such Terms and the Apartment Provider’s General Policies as if they were referred to as you under these Terms. In the event of such a party breaching any of these Terms or the Apartment Provider’s General Policies such a breach will for the purpose of these Terms be considered a breach by you. If we don’t supply the Apartment Provider’s General Policies then it’s your responsibility to establish with the Apartment Provider the basis on which they make the serviced apartment available and whether any Apartment Provider General Policies apply.

Booking process and reservation procedures

  • You can make an enquiry about reserving a serviced apartment (a “Reservation Request”) through our website (www.mydestinationnationcom ) (“Site”), by phone or by email and we’ll endeavour to respond with some suitable apartment options and suggestions that meet your requirements. If we’re unable to offer suitable suggestions our team will be in touch to discuss other options. Please be aware that all serviced apartment options presented in response to your Reservation Requests are subject to availability.
  • Once we’ve received your confirmation to make a reservation, we’ll endeavour to make that reservation and ensure the apartment is on hold. Your instructions to make a Reservation will be deemed an offer by you which will only be deemed accepted once the Apartment Provider has accepted your Reservation.
  • If your Reservation is accepted, we will send you the “Apartment Reservation Confirmation” which will amongst other things confirm the dates of your stay, the charges to be paid by you (“Apartment Charges”), the relevant payment terms, check-in and check-out times, cancellation terms and property contact details. In the event that we’ve not been able to secure your Reservation, we will notify you immediately and if possible, suggest suitable alternative apartments options.

Our role and responsibilities

  • As a serviced apartment booking agency, we provide information and details on our website, in relation to corporate housing and serviced apartments. If you inform us to make a Reservation, we will, as detailed in clause 2 above, endeavour to make the Reservation on your behalf, with the apartment provider/supplier.
  • Once we’ve received payment of the Apartment Charges from you in respect of a Reservation you’ve made, we’ll process these payments, and arrange for the appropriate payment to be made to the relevant Apartment Provider.

Payment

  • Payment is required at the time of booking, unless otherwise agreed or set forth in the reservation information. If payment does not reach us at the required time, we reserve the right to suspend or cancel any booking made.  Any late payments will result in interest being charged at 3% above Bank of England base rate for the period concerned.
    Payment should be made by Bank Transfer. (Bank details are available on request as are other payment methods, online secure payments and or client agreed payment terms)

Tax

The Apartment rates are given exclusive of any “Local Sales Tax” being any sales tax which is levied upon the provision of the Apartment. We will always provide you with information of any City Sales Tax you have to pay. For example, in the United Kingdom, London the VAT is payable at 20% on the first 28 nights of a stay and then at 4% from night 29 onwards of your stay.

We shall notify you if the position regarding Sales Tax changes between the date your Reservation is confirmed by us and the date of your stay at the Apartment. In such circumstances, and if necessary to comply with applicable law, where the Sales Tax (1), has increased, we will require you to pay any additional Sales Tax, (2) has reduced, we shall refund any overpayment of Sales Tax to you.

Pricing

The rates we advertise are to the best of our knowledge correct at the date of publication but we reserve the right to change any rates in line with market prices. Prior to the booking being confirmed rates quoted are based on the rates prevailing at the time but may be subject to change.  Once a booking has been confirmed we will not change the rate quoted unless you amend the booking dates or our cost of supplying the accommodation changes as a result of tax changes or currency fluctuations beyond our control. 

Information required

To process your Reservation and secure a reservation, we will require certain assistance and information from you, such as your contact details, the number of guests staying, their names and contact details, ID etc. You agree that you’ll promptly provide us with all such assistance and information that we may require during the booking process and in relation to the information that it will be accurate, complete and up-to-date. Furthermore, you agree to notify us, if there are any changes to such information.

  • Data Protection
    Any information you provide to us will be handled in accordance with our Privacy and Cookies & data protection Policy. Where you provide us with information about a third party (including Guests), you confirm that you have their authority to provide such information to us, for use in accordance with our Privacy and Cookies Policy. You acknowledge that we may pass information to the Apartment Providers and we will not be responsible for the use made by them of that information.

Payments and deposits

  • The Apartment costs, for the serviced apartment reservation, will be as confirmed in the Apartment Reservation Confirmation or as otherwise agreed between the parties.

    United Kingdom Reservations: The Apartment rate quoted are given exclusive of VAT, which you will pay in addition to the Apartment Charges at the current rate.

    All other countries Reservations: local taxes (including value added tax or any other applicable tax in the country the apartment is located) are normally excluded in the rates that we’ve quoted. We will make it clear what those local taxes are at the time of quotation and booking.
  • You will pay us the Apartment Charges in full and by the due date as agreed during the booking process and all payments will be made in the currency quoted at the time of booking or in pounds sterling and USD, unless otherwise agreed with Destination Nation.
  • The apartment supplier/provider may as a condition of the Reservation, at times require a security deposit to cover any additional charges incurred, and to cover any damage or loss caused to the serviced apartments. This may be requested by the Apartment Provider (or by us on their behalf at any time before or on arrival and you agree to provide this security deposit if required and, on the terms, requested by the Apartment Provider or by us.
  • All reservations made with via credit card with Destination Nation will incur a non-refundable booking processing fee, at the time of booking. We will advise of any associated processing costs at the time of making your reservation.

Changes, Extensions and Cancellations

All requests for changes, extensions and cancellations must be made in writing directly to your Destination Nation representative. Failure to extend, cancel or modify your reservation or booking directly with Destination Nation may result in you being liable to pay us the full amount of the booking.

Booking Changes

If you wish to change any detail of your confirmed booking Destination Nation will use all reasonable efforts to make the change.  All changes of dates are subject to availability.  Should any change be rejected, you will be responsible for the original booking.  Name changes or child age changes will not incur any charges or administration fees.

Extensions

If you wish to extend a reservation, please give your Destination Nation representative as much notice as possible in order to facilitate your request. All extensions are subject to availability and potential rate change.   Where notice to extend a stay has been given, we will only confirm this only when additional payment has been made in accordance with your booking details.

Cancellations and Early Departures 

Your cancellation policy is clarified at the time of enquiry or booking and upon request.  

Early Departures: Destination Nation reserves the right to treat an early departure or reduction in the number of nights or apartments booked as a cancellation and apartments may then be re-let and cancellation charges will apply. If pricing is provided based on a minimum length of stay and the total number of nights reduces as a result of early departure, we reserve the right to increase the rate per night, retrospectively, from the first day of the reservation.

Non-arrivals: will be treated as a cancellation and you will be responsible for the cancellation fee.
Please note that transaction fees are not refundable in the event of a cancellation.

Notice Period

Your notice to vacate and cancellation policy is unique to the property you reserve. Destination Nation will communicate this policy to you via email at the time of booking.

Sublease

Lessee/Occupant(s) shall not sublet all or a portion of the premises or assign the Agreement without the prior written consent of Destination and the provider. Any sublet or assignment will not release Lessee/Occupant(s) from liability.

Changes by Us

We do not expect to have to make any changes to your booking however occasionally bookings have to be changed or cancelled or errors in information or other details corrected and we reserve the right to do so.  If this does happen, we will let contact you as soon as possible.  If a change must be made or your booking must be cancelled, we will, where possible, offer you an alternative apartment of similar type and standard in a similar location for the same period.  If you do not wish to accept a change or any alternative apartment offered or we cannot offer you a suitable alternative apartment, you may be entitled to cancel your booking and receive a refund unless this is the result of an Event beyond our Control – see below.  You should tell us as soon as possible whether you wish to accept any change or alternative apartment offered or alternatively if you want a refund. 

Events beyond our control include but are not limited to the following: the act of God, an outbreak of hostilities, riot, civil disturbance, acts of terrorism, revolution, the act of any government or authority (including but not limited to refusal or revocation of any license or consent), fire, flood, lightning, explosion, fog or bad weather, epidemic, interruption or failure of a utility service (including but not limited to electricity, gas, water or telecommunications), renovations and building work undertaken at the property or in the local area, strikes, lockouts or boycotts, embargo, blockade.

Insurance

We cannot accept liability for the theft and/or damage of your personal belongings during your stay. Therefore, we advise you to take appropriate travel or renters’ insurance. In addition, we advise you to ensure you have taken appropriate travel insurance to cover any unexpected cancellation or medical expenses.

Website 

Reasonable care has been taken to ensure that the content of our website (and/or other means of promotion or advertising) is correct but it is subject to amendment at any time without notice. All content on our website (and/or other means of promotion or advertising) is published in good faith but you acknowledge that we cannot check the accuracy of all information provided.  Given the above factors, we do not warrant that any of the content on our website (and/or other means of promotion or advertising) accurately or completely describes any of the apartments. Our website may link to other websites and we are not responsible for the data policies, content or security of these linked websites.   Our website (and/or other means of promotion or advertising) will only have a general representation of the accommodation shown. Actual apartment size, design, fixtures, furnishings and facilities may vary.

Pets

Please note that you are not permitted to allow pets (or any other animals) into the Apartments without our prior written approval. If you wish to bring your pet with you to the Apartment, please contact us.

If we, or the Apartment Provider, have agreed to you having a pet in the Apartment, you will be required to comply with any additional rules made available by the Apartment Provider in relation to the same. Furthermore, a security deposit will be required which will be refundable at the end of your stay, provided the Apartment has been left in a satisfactory condition. Please also note that an additional cleaning fee will be required on departure and details of these will be provided to you in advance.

Health & Safety

We will endeavour to pass on to you any information we receive from the Apartment Provider relating to its health and safety policies, but because we do not own or manage the Apartments, we cannot and do not provide any warranty or representation in respect of health and safety related matters concerning the Apartments (including the Apartment Provider’s health and safety policies) or the condition of the Apartments. Please contact us if you have any questions regarding the Apartment Provider’s health and safety policies or you become aware of any health and safety issues during your stay.

Liability

We will provide you with reasonable assistance if you have an issue in respect of the Reservations, the Apartment, your use of it or any acts or omissions of the Apartment Provider (Apartment Issue). Please contact us immediately if you have an Apartment Issue. We will try to help, including taking the Apartment Issue up with the Apartment Provider

Destination Nation ltd act as a reservation agent for and on behalf of our Apartment Providers and liaise with the Apartment Provider to complete the Reservation on your behalf. We do not own any of the Apartments featured on our Website. The Apartments are owned and operated by the Apartment Providers or suppliers, or owned by third party landlords who appoint the Apartment Providers to take reservations for the Apartments on the landlord’s behalf or allow Apartment Providers to take reservations on their own behalf.

We are not responsible for yours (or a Guests) use of the Apartment or any acts or omissions of the Apartment Provider. We will attempt to help you resolve any issues as set out in above. Ultimately, though, it is the Apartment Provider who is responsible directly to you for the Apartment. Our obligation to you in relation to any issues regarding the Apartment.

The only liability we may have to you in relation to a Reservation or a Apartment will be: to the extent that we make any errors or provide inaccurate information concerning the Apartments as set out in the Apartment Reservation Confirmation, provided the error or inaccuracy was entirely our mistake (determined by us acting reasonably) and not the mistake of the Apartment Provider; or

Or to the extent that we make any error in relation to the Reservation itself (for example, reserving the wrong number of nights) again provided such error was our mistake and not the mistake of the Apartment Provider.

Any liability we do have to you will in any event be limited to the Apartment Charges that you pay to us in relation to the Reservation (or Reservations) to which such liability relates.

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms. However, we are not responsible for any loss or damage that is not foreseeable.

Nothing in these Terms seeks to limit or exclude our liability for death or personal injury which is caused by our negligence or for any other matter which we are not permitted by law to limit or exclude.

Where relevant we will have no contractual liability whatsoever to any Guest on whose behalf you have reserved the Apartment for and it is your responsibility to explain to them the basis upon which the Reservation has been made.

All warranties, expressed or implied whether by statute, common law or otherwise are excluded to the fullest extent permitted by law.

You agree to compensate us against all and any loss, damages and costs sustained by us arising out of any breach by you (or any person or people on whose behalf you make a Reservation for or who otherwise use the Apartment) of any of these Terms or the Apartment Provider’s General Policies.

Variation

Destination Nation may amend these Terms from time to time and make the revised and updated version available on our Website.

Where we amend these Terms, any revisions or amendments will not impact upon any Reservations confirmed prior to the date of variation of these Terms, unless required by applicable law.

Illegality

If any provision of these Terms is prohibited by law or judged by a court to be unlawful, void or unenforceable, the provision will, to the extent required, be severed from these Terms and rendered ineffective as far as possible without modifying the remaining provisions of these Terms, and will not in any way affect any other circumstances or the validity or enforcement of these Terms.

Rights of third parties

No party other than we or you may enforce any provision under such Terms.
Destination Nation ltd may enforce these Terms in relation to a Reservation it has made.

Applicable law and jurisdiction

These Terms will be governed by the laws of England and Wales and the English courts will have exclusive jurisdiction in relation to any dispute with respect to the subject matter or construction of these Terms.
